% 03.05.2018 After some arguments, the learned counsel for the appellant states that without prejudice to his rights and contentions, he would not press the appeal but would request that the Trial Court be directed to expedite the disposal of the suit. The case is at the stage of recording of evidence of the respondent (plaintiff in the suit). In view of the above, the appeal is dismissed as withdrawn. The Trial Court is requested to expedite the trial of the suit and endeavour to dispose the suit off depending upon the list of cases before its board, preferably by the end of the year. The learned counsel for the parties submit that they would not seek any adjournment in the matter when it is listed before the Trial Court and shall promptly lead their respective evidence within a month each or through expedited method of recording of evidence. The Trial Court Record be returned forthwith.
The parties shall appear before the Trial Court on 14.05.2018. NAJMI WAZIRI, J.
