% 20.03.2018 Notice could not be issued to the respondent no. 2 as process fee was not filed.

However, respondent no. 2 has appeared in Court through his counsel and accepts notice. Respondent no. 2 has been identified by ASI Sunita of police station Harsh Vihar. It is submitted that a quarrel took place between them on some trivial issues, resulting in simple injuries to respondent no. 2. Respondent no. 2 admits having settled the matter with petitioners of his own free will, voluntarily and without any undue force, pressure or coercion and he has no objection in case FIR is quashed against the petitioners. Affidavit of respondent no. 2 is also on record.

Keeping in mind the settlement arrived at between the petitioners and respondent no. 2 voluntarily, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR no.538/2014 under Sections 308/323/341/34 IPC registered at police station Harsh Vihar and the consequent proceedings emanating therefrom are quashed.
