O R D E R

% 25.01.2017 This is an application filed under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No. 286/2013, under Sections 406/34 IPC registered at Police Station-Burari.

Counsel for the petitioner has submitted that the petitioner is apprehending his arrest from Police Station-Burari in case FIR No. 286/2013, under Sections 406/34 IPC. Counsel for the petitioner has further submitted that the petitioner is an innocent person and is a law abiding citizen and is ready to join investigation whenever and wherever required. He has further submitted that nothing is to be recovered at the instance of the petitioner as in the instant case civil suit qua against the petitioner on the same cause of action has already been filed by the respondent which is pending adjudication. He has further submitted that since nothing is to be recovered from the petitioner and nothing further is to be investigated, the

petitioner be released on anticipatory bail.

Learned APP for State has filed status report and has vehemently opposed the bail application and submitted that the petitioner's signature on the receipt have been matched for consideration amount of rupees two lakhs by FSL. He has further submitted that the petitioner is not cooperating in the investigation.

Keeping in view the facts and circumstances as nothing is required to be recovered at the instance of the petitioner, in the event of arrest of the petitioner, he be released on anticipatory bail in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of IO/SHO with directions to the petitioner to join the investigation.
