% 30.01.2020 This petition has been filed seeking transfer of CS (OS) No. 2726/2011 (now numbered as CS No. 578052 / 2016), titled Hukam Chand Sharma & Ors vs Sumitra & Ors, pending before the Court of the learned Additional District Judge-04, North West, Rohini Court, Delhi to the Court of the learned District Judge, Karkardooma Court, Delhi. The ground for seeking transfer is that the suit was originally filed before this Court and was transferred on the increase of pecuniary jurisdiction of this Court. The suit is one for partition, possession, permanent injunction and cancellation of Sale Deed. The suit property is stated to be situated within the jurisdiction of the District North East, Karkardooma Court.

The learned counsel for the respondent nos. 6 to 8 submits that the

said respondents have no objection to the present petition being allowed. The other respondents have remained ex parte in spite of service. In view of the above, suit being CS (OS) No. 2726/2011 (now numbered as CS No. 578052 / 2016), titled Hukam Chand Sharma & Ors vs Sumitra & Ors, pending before the Court of the learned Additional District Judge-04, North West, Rohini Court, Delhi is transferred to the Court of the learned District Judge, District North-East, Karkardooma Court, Delhi to be listed before the transferee Court on 24th February, 2020. The petition is allowed in the above terms. There shall be no order as to costs.
