% 09.05.2016 In case all the orders are read in a meaningful manner, the present petition is treated as a fresh petition.

Learned counsel for the petitioner states that the Arbitral Tribunal has already been constituted. He seeks liberty to move an application under Section 17 of Arbitration and Conciliation Act, 1996, if necessary, before the Arbitral Tribunal. Learned counsel for the respondent states that the issue with regard to the territorial jurisdiction be kept open so that the respondent will raise the same before the Arbitral Tribunal. Without expressing any opinion on the two versions raised by the parties, liberty is granted to the petitioner to move an application under Section 17 of the Act before the Arbitral Tribunal. In view thereof, learned counsel for the petitioner does not press the present petition. The same is accordingly disposed of as not pressed.
