% 27.11.2017 By this petition the petitioner seeks quashing of FIR No.228/2017 registered at PS Khajuri Khas under Section 376 and 4/6 of POCSO Act. The claim of the petitioner seeking quashing in the present petition is that the parties have now married each other.
Offence under Section 376 IPC being a various serious offence, the same cannot be compounded or an FIR thereto cannot be quashed without there being material on the record. Mere marriage after the incident would not be a mitigating ground for quashing of the FIR. Consequently, the petition and application are dismissed. MUKTA GUPTA, J.
