versus STATE & ANR.

..... Respondents Through Ms.Richa Kapoor, ASC with Mr.Ashish Negi & Mr.Rohit Kaul, Advs.

SI Manoj PS Kanjhawala.

CORAM:

HON'BLE MR. JUSTICE ASHUTOSH KUMAR

O R D E R

% 23.09.2015 The petitioner is a major (date of birth 24.01.1997). She, on her own volition and accord, married one Nitin in accordance with Hindu religious rites on 26.06.2015.

The aforesaid marriage of the petitioner has not been accepted by her father (respondent no.6). As a result thereof, respondent nos.4 & 5 who are the brothers of respondent no.6 have been doling out threats to the petitioner and to her matrimonial family.

The petitioner has stated that she lodged a complaint regarding such threats to her and her family, before the police authorities but no action has been taken till date.

Hence, the writ petition.

Ms.Richa Kapoor, Additional Standing Counsel, with reference to the

status report, submits that the father of the petitioner has lodged FIR No.456/2015 (PS Kanjhawala) dated 26.06.2015 for offence under Section 365 with the aid of Section 34 IPC.

When the father of the petitioner was contacted by the police, he, in categorical terms, made it known that because of her daughter having married somebody of her own choice and not with the consent of the family, she has been disowned. Police personnel were also shown the publication made by the father of the petitioner in that regard in various newspapers. The brothers of the father of the petitioner, on being contacted, also expressed their complete detachment with the petitioner. It appears that with the passage of time, the anger has abated but the marriage of the petitioner with Nitin has not been accepted. The threat perception, as of now, continues despite the respondents having wash their hands off the affairs of the petitioner or her husband or the entire matrimonial family.

The petitioner is present in this Court with her mother-in-law. Mother-in-law of the petitioner has stated that her family has accepted the marriage of the petitioner with Nitin, her son. It has been submitted on behalf of the State that there is a possibility of a closure report being filed in the FIR which has been lodged by the father of the petitioner. Till such time that the issue remains alive, the police would afford protection to the petitioner and her matrimonial family as and when required.

The SHO of the police station Kanjhawala is directed to give his mobile telephone number and mobile telephone number of another official of the police station to the petitioner and her mother-in-law who could

contact them in case of emergency.

The SHO or the other officials concerned would be expected, on receiving any such SOS call, to act with the urgent despatch and in accordance with law.

With these observations, petition is disposed of accordingly. Dasti.
