% 01.08.2017 CM No.27009/2017 (Exemption Exemption allowed, subject to all just exceptions. Application stands disposed of.

FAO (OS)221/2017 & CM No.27008/2017 In view of the earlier interim orders dated 12.04.2017, 21.04.2017, 12.05.2017 and 26.05.2017, counsels states that the salary along with increment may be paid to the employees. It is clarified that this statement on behalf of the respondents is without prejudice to their rights and contentions and to the submission that Javed Akhter and S. Rajagopalan are not entitled

to any salary as their services stood terminated. Learned counsel for the appellant has contested the said submission but we observe that this aspect is to be examined by the Court. It is also clarified that if ultimately it is found that the salary to the said two persons was not payable, the appellant will compensate the same to Hamdard Laboratories (India). Counsels for the parties state that on 30.08.2017 they will argue the applications on merits before learned Single Judge. Counsels for the parties state that they will fully cooperate and ensure that the salaries are disbursed expeditiously preferably within 48 hours. In view of aforesaid statement and observations, present appeal along with pending application stands disposed of.

Copy of the order be given dasti under the signature of the Court Master.
