O R D E R

% 24.11.2017 This is a petition under Section 11 of the Arbitration & Conciliation Act, 1996 (hereinafter referred to as the 'Act') seeking appointment of an Arbitrator for adjudication of the disputes that have arisen between the parties in connection with the Letter of Intent dated 07.01.2011for Supply, Erection, Installation, Testing and Commissioning of Electrical and Plumbing Works for the Phase II Township to be built for the 4000 MW Ultra Mega Power Project at Mundra (Gujarat). Learned counsel for the respondent submits without in any manner admitting the contents of the petition, the respondent has no objection, if a Sole Arbitrator is appointed for adjudication of the disputes. With the consent of the parties, parties are referred to the Delhi International Arbitration Centre (DIAC) who shall appoint a Sole Arbitrator, preferably a retired Additional District Judge, to adjudicate the disputes

between the parties. All contentions of either party will remain open before the Arbitrator. The arbitration and the fee shall be governed by the rules of the DIAC.

The parties to appear before DIAC on 12th December, 2017 at 2.00 P.M.

The petition is allowed in the above terms.
