% 03.02.2017 Present writ petition has been filed by a daughter and maternal grandson challenging the allotment letter dated 19th January, 2007 issued with respect to plot no. 54, Block D, Village Rangpuri, Vasant Kunj, New Delhi and to issue an allotment letter and conveyance deed in favour of the legal heirs of Late Shri Prabhu Deva @ Prabhu Dayal. Respondent nos. 2 to 8 who are sons and paternal grandchildren of Late Shri Prabhu Dayal have not entered appearance despite service. Accordingly, they are proceeded ex-parte.

Today in Court, learned counsel for respondent-DDA has handed over a photocopy of the letters dated 1st February, 2017 written by Deputy Director/LA(R), DDA to the petitioners. One such letter is reproduced hereinbelow:-

"No. F.18(157)2005/LAB/(R)/197 Dated 1-2-2017 To, 1.

Sh. Rajesh S/o Late Sh. Ramanand, R/o Plot No. 484, Sector-19, Dwarka, New Delhi-110075 R/o 29 B, N Block, Gopal Nagar Dhansa Road, Najafgarh, Delhi 110 043 Sub.:

Regarding mutation of plot No. D-54, Rangpuri in favour of Legal Heirs of Late Sh. Prabhu.

As per the directions of the Hon'ble High Court regarding the mutation of plot no D-54, Rangpuri in favour of the legal heirs of late Sh. Prabhu, needs to be done by DDA. In this regard you are requested to submit the following documents enabling us to take further action per the directions of the High Court.

1. Original Death Certificate of Smt. Bala w/o late Sh. Ramanand.

2. Documentary proof which shows that she is the daughter of Late Sh. Prabhu duly attested by the Gazetted Officer. Sd/- Dy. Director/LA(R)"

In view of the aforesaid letter, learned counsel for the petitioner does not wish to press the present writ petition any further. He, however, states that in the event he has any difficulty subsequently, he may be given liberty to seek revival of the present petition.

Consequently, after taking on record the respondent-DDA's letter dated 1st February, 2017, present writ petition is disposed of with aforesaid liberty as satisfied.
