This execution petition is filed for issue of transfer certificate for the decree passed in favour of the decree holder/petitioner. 2.

It is pointed out that on 24.10.2009, the award was made and published by the learned arbitrator in favour of the decree holder/petitioner. On 18.07.2011 the award was made rule of the court. Thereafter, the appeal filed by the judgment debtor/respondent was allowed on 10.01.2012 and the matter was remanded back to the court for further hearing. On 10.01.2017, the objections filed by the judgment debtor/respondent under Section 30 of the Arbitration & Conciliation Act, 1940 have been dismissed by this court. The award was made on the rule of the court. Hence, the present execution petition is filed for issue of transfer certificate to the Mumbai High Court for execution as the assets are located in Mumbai. 3.

In view of the above, the request of the petitioner is allowed. The

decree is transferred to the Mumbai High Court for execution. As requested, the transfer certificate be issued dasti to the learned counsel for the petitioner.
