Having heard the learned counsels for the parties and on perusal of the record, the petitioner is seeking initiation of contempt proceedings against the respondents/Delhi Cantonment Board for the alleged wilful disobedience of the directions of this Court dated 16.12.2016 in W.P.(C) No. 11494/2016, as also reneging on the undertaking given on behalf of respondent No.1 in the affidavit dated 15.12.2016.

During the course of the arguments, it is brought out that the respondent No.1 had taken appropriate action against the respondent No.2/owner/occupier of the property in question and an appeal was preferred under Section 340 of the Cantonment Act, 2006, which stood dismissed vide order dated 03.04.2019. Aggrieved thereof, the said order has been assailed in W.P.(C) No. 6374/2019 before this The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Court, whereby the proposed action of respondent of No.1 for demolition of the property has been stayed vide order dated 30.05.2019. The said writ is still sub-judice before this Court. 3.

In view of the above, there is no issue of wilful disobedience on the part of the respondent No.1 in complying with the directions of this Court. The present contempt petition is dismissed.
