% 23.11.2017 Ld. counsel for the petitioner seeks withdrawal of the petition. Petitioner approached this Court alleging unauthorized construction in property bearing no. H-2 & H-3, Arjun Nagar, Safdarjung Enclave, Humayun Pur, New Delhi. In the status report dated 17.11.2017, it has come to be stated, as follows : "....................................................................................................... ..................................................................................................... 3.

That it is submitted that in respect of the property in question, upon availability of police force, the answering respondent No./SDMC has taken sealing action on 16/11/2017 vide which seal has been affixed at Third floor at one point at entrance of subject property bearing No. H-2, Arjun Nagar, Safdarjung Enclave, New Delhi, thereby making the entire Third floor inaccessible. Photographs taken after seal affixed are annexed herewith as Annexure R-1/A.

That furthermore, it is submitted that the department has fixed the further action programme against the subject

property on 24/11/2017, which will be taken/carried out upon availability of police force."

In view of the prayer made on behalf of the petitioner for withdrawal, as also the action taken and contemplated, the petition is disposed off.

Liberty is however, reserved to the petitioner to approach this Court afresh, if, fresh cause of action arises. A. K. CHAWLA, J NOVEMBER 23, 2017 rc
