O R D E R

% 03.12.2018 Learned counsel for the petitioner submits that petitioner is in custody for more than three months. Petitioner is neighbour of the prosecutrix. In FIR, prosecutrix has stated that petitioner along with co-accused tried to take her forcibly with them and left her when she raised alarm. However, in her statement under Section 164 Cr.P.C., she has improved her version. In her subsequent statement, she alleged that co-accused Amir was armed with a knife, which fact she had not disclosed in the FIR. Learned APP has opposed the grant of bail to petitioner. She says that allegations against the petitioner are serious in nature. Petitioner tried to commit rape upon the prosecutrix.

Learned counsel for the petitioner submits that allegations of rape have not been levelled in the FIR.

Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `20,000/- (Rupees Twenty Thousand Only) with one surety in the like amount to the satisfaction of the trial court. Bail application is disposed of in the above terms. Dasti.
