Petitioner Imran seeks regular bail after being in custody for nearly 2V2 months and Smt. Shehnaz seeks anticipatory bail in case FIR BAIL APPLN. 2627/2016 & BAIL APPLN. 2407/2016 By:AMULYA
No.ri49/20i6 under Sections 307/323 IPC registered at PS Jamia Nagar. 2.
The above noted FIR was registered on the statement of the complainant who stated that she got married to Imran as per muslim rites on 8^*^ May, 2014. ' She alleged that after three months of her marriage, she came to know that Irriran was already married and his,earlier wife was living somewhere in Noida. Thereafter, Imran left her at her parental home and she lived there for 9 months. After 9 months, she accompanied Imran to the matrimonial home. Imran used to come home after interval of several days. On the day of incident i.e. 25"^ October, 2016 Imran returned home after a gap of 4 days and she served him meal. Then she came to her bedroom. Her mother-in-law and Imran were talking on the ground floor. At about 5.
30 PM, Imran came to her bedroom and when she complained that if she had to live there alone, then why he had brought her from her parents house, Imran started beating her. In the meantime, her mother in law and sister in law also came there. She wanted to call at 100 number but the call could not be connected and in the meantime, they tried to sniatch her phone. Her brother-in-law closed the door and Imran took out a small bottle from the pocket and poured it on her. It smelled of kerosene oil. Therafter, Imran asked her for a lighter. However, she was able to free herself. She made a call to her mother stating that they would kill her. In the meantime, her mother came up with the police and Imran left on seeing the police. , 3.
Considering the fact that the main role has been attributed to Imram, who has been in custody for nearly VA months and custodial interrogation is no more required, this Court deems it fit to grant bail to Imran and anticipatory bail to Smt. Shehnaz. It is thus, directed that the petitioner BAIL APPLN. 2627/2016 & BAIL APPLK 2407/2016
Imran be released on bail on his furnishing a personal bond in the sum of ?25000/- with one surety of the like amount, subject to satisfaction of the learned Trial Court, further subject to condition that he will join the investigation as and when directed and will not leave the country without prior permission of the concerned Court. It is further directed that in the event of arrest, petitioner Shehnaz be released on bail on her furnishing a personal bond in the sum of ^25000/- with one surety of the like amount, subject to the satisfaction of Arresting Officer/SHO concerned, further subject to the condition that she will join the investigation as and when directed and will not leave the country without prior permission of the concerned Court.
