CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 19.12.2016 Petitioner and respondent no. 3 are known to each other. It is submitted that a quarrel took place between them on some trivial matter wherein petitioner gave beatings to the respondent no. 3. This incident led to registration of FIR 205/16 under Sections 324/341/34 IPC against the petitioner at police station Hauz Qazi.

It is submitted that with the intervention of common friends and other family members, petitioner and respondent no.3 have settled their disputes amicably vide compromise deed dated 2nd December, 2016. Respondent no. 3 is present in Court and submits that he has settled the matter with the petitioner of his own free will and without any undue pressure, force or coercion.

Learned ASC for the State submits that one another person by the name of 'J.D.' has also been named in the FIR. Respondent no. 3 submits that he does not know any person by the name of J.D. and he heard this name by some passersby and out of this confusion he has given this name in the FIR. He further submits that he does not wish to pursue the FIR against that unknown person as well.

Keeping in mind the settlement and that the respondent no. 3 is not willing to pursue the FIR any further, in the interest of justice, FIR No. 205/16 under Sections 324/341/34 IPC registered at police station Hauz Qazi and the consequent proceedings emanating therefrom are quashed. Writ petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
