% 30.10.2017 The petitioner has filed the present petition seeking release of his vehicle which has been seized by the Excise Department. The vehicle in question was being used for carrying illicit liquor. In view of the judgment delivered in State (NCT of Delhi) vs. Narender 2014(2) JCC 1247 and Section 61 of the Delhi Excise Act, 2009, no such order of release of vehicle can be passed by this Court. The provisions of Sections 451, 452 and 457 of the Cr.P.C. have to yield to the specific provision of Delhi Excise Act, 2009. The present, petition, therefore is dismissed.
