The present petition has been filed by the petitioner praying inter alia for issuing directions to the respondent to approve the voluntary retirement application submitted by him on 28.4.2018.

Learned counsel for the petitioner submits that vide the order dated 12.5.2018, the Competent Authority namely, the Commandant, 100 Bn. RAF, has refused to accept the request for voluntary retirement submitted by the petitioner on the ground that a criminal case is pending against him and the said decision was communicated to him under cover of letter dated 22.5.2018. By the said letter, the petitioner was informed that since the competent authority has not accepted his request for the voluntary retirement, he was required to await the order that may be passed by the Inspector General of Police, RAF, New Delhi.

Learned counsel for the petitioner states that after waiting for a reasonable time, he has had to file the present petition as no order has been passed so far by the Inspector General of Police RAF, New Delhi. 4.

In view of the limited relief prayed for and with the consent of the parties, the present petition is disposed of with directions issued to the respondent to ensure that the order passed by the Inspector General of Police, RFA, New Delhi is communicated to the petitioner within two weeks from today.

If the grievance of the petitioner still survives, he shall be entitled to seek legal recourse, as may be advised.
