Counsel for the appellant says that the impugned judgment which decreed the suit for specific performance and in the alternative for damages, is now the subject matter of execution proceedings for specific performance and appellant has agreed to grant of relief of specific performance and with respect to which talks are going on between the parties in the execution proceedings. 2.
