% 09.02.2017 This is an application under Section 438 Cr.P.C. filed on behalf of the petitioner for grant of anticipatory bail in case FIR No.0561/2016, under Sections 420/468/34 IPC, registered at Police Station Hauz Khas, New Delhi.
Learned counsel for the petitioner submits that the petitioner is apprehending arrest in FIR No.0561/2016, under Sections 420/468/34 IPC, registered at Police Station Hauz Khas, New Delhi and prays that the petitioner be granted anticipatory bail.
Learned APP for State has submitted that the petitioner is not cooperating in the investigation despite repeated request. He has further submitted that the custodial interrogation of the petitioner is required to unearth the involvement of other co-accused in forging the fitness
certificates of 43 passports. He has further submitted that the petitioner is required for further custodial interrogation of the case and prays that the petitioner be not granted anticipatory bail.
In view of the submissions made by learned APP for State since the petitioner is not cooperating in the investigation by giving vague reply and the petitioner is required for custodial interrogation to unearth the involvement of other co-accused, the present application is dismissed. The present petition is disposed of accordingly. All pending application(s) (if any) also stand disposed of. Copy of this order be given dasti.
