The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.445/2015 registered under Sections 420/406 IPC at PS New Friends Colony. Status report is on record. 2.

I have heard the learned counsel for the parties including the complainant in person and have examined the file. The petitioner is in custody since 20.05.2016.

He was involved in case FIR No.0157/2016 registered under Sections 420/468/506 IPC at PS Baba Haridas Nagar and has been granted bail by an order dated 14.10.2016.

During the course of arguments, petitioner's counsel, on instructions, volunteered to pay `5 lacs to the complainant without BAIL APPLN. 2634/2016

prejudice and subject to future adjustment (if any). 4.

Considering the facts and circumstances of the case and the petitioner's offer to pay `5 lacs to the victims without prejudice and subject to future adjustment, the petitioner is admitted to bail on furnishing personal bond in the sum of ` 40,000/- with one surety in the like amount to the satisfaction of the Trial Court. 5.

The petitioner shall deposit `5 lacs with the Investigating Officer. `3 lacs shall be deposited within two weeks and remaining amount of `2 lacs within two months thereafter. This payment shall be without prejudice and subject to future adjustment (if any). 6.

The victims may move the Trial Court for release of the amount so deposited. The Trial Court after considering the contentions of the various victims may order release of the amount proportionately to them.

In case of non-compliance, State shall be at liberty to approach this Court.

The bail application stands disposed of.
