W.P. (Crl.) No.2194/2017 This is a petition under Article 226 of the Constitution of India filed by the father of 20 years old boy who is stated to be missing since 28.07.2017. On an advance copy having been served, learned counsel for the State has handed over a status report in Court. Counsel submits that the present petition is a gross abuse of the process of the Court and false and frivolous allegations have been made. Petitioner is fully aware that his son is in judicial custody pursuant
to an FIR No.205/2017, registered under Section 392/34 IPC, Police Station Shahdara. It has also been brought to the notice of the Court that the concerned person stands arrested. Information of his arrest was given to his brother Qasim Khan on his Mobile No.9873787009. Further, Asif Ali was produced before the concerned Court at Karkardooma, Shahdara on 28.07.2017 and has been remanded to judicial custody till 11.08.2017. In view of the status report, we find that the present petition is not maintainable. At this stage, Mr.Barqi, learned counsel for the petitioner submits that he has instructions to withdraw this petition. Accordingly, the same is dismissed as withdrawn. Mr.Barqi submits that he would seek necessary remedy, as according to him, various guidelines have been violated by the Delhi Police, which is disputed by the learned counsel for the State.
