% 21.03.2018 After some hearing, the learned counsel for the petitioner submits that he may be permitted to withdraw the present petition challenging the order dated 28.10.2016 passed by the Civil Judge on his eviction case (old execution case. 15/2014 - new execution no. 95846/16) which proceedings were inadvertently wrongly instituted, the appropriate execution court for purposes of award under Arbitration and Conciliation Act, 1996 being the Court of District Judge. He, thus, also seeks liberty to file a fresh execution application before the appropriate jurisdictional court. The petition is dismissed as withdrawn with liberty as prayed, granted.
