% 18.01.2017 The present bail application has been filed under Section 439 read with Section 482 Cr.P.C. for the grant of bail in FIR No.56/2015, under Section 307/34 IPC, Police Station C.R. Park. It is apparent from the record that earlier a bail application bearing Bail Appln. 1611/2016 came up for hearing before this Court on 09.08.2016 in which it was observed as under : "The prosecution will make sincere efforts to get the FSL report at the earliest. Since the accused is in custody since 09.02.2015, the Trial Court will endeavour to expedite the trial."

It has been submitted that now the FSL report was received yesterday. Copy of the FSL report has been supplied to the counsel for the petitioner.

It is further submitted that the matter is fixed for 03.02.2017 before the trial court for evidence of the complainant. The present application is disposed of with the observations that the trial court shall endeavour to conclude the evidence of the complainant as well as of the public witnesses must be at the earliest. The prosecution shall move the application before the trial court and have the summons of the public witnesses.

The present application is dismissed as not pressed at this stage with the liberty to move the application on the completion of evidence of the public witnesses.
