O R D E R

% 08.10.2018 By this petition, the petitioner seeks parole on the ground that he has to file SLP, arrange funds and to re-establish social ties with family members and society and also challenges the communication dated 18th May, 2017, whereby his parole application was rejected on the ground that he has undergone only four years, seven months and there was no compelling reasons.

Perusal of the nominal roll reveals that the petitioner has been in custody from 9th December, 2012. Various status reports have been filed by the State. It transpires that the mother of the petitioner is residing with her daughter and Son-in-Law. The sister of the petitioner has refused to stand surety for the petitioner. Wife of the petitioner is estranged for the reason W.P.(CRL) 2264/2017

that the petitioner has been convicted for the murder of his sister-in-Law's husband. Thus, apparently, there is no family member, who would stand surety for the petitioner.

Considering the period undergone and the fact that there is no responsible person, who can stand surety for the petitioner, at this stage, this Court finds no ground to grant parole to the petitioner or set aside the order dated 18th May, 2017. Petitioner can avail the services of legal aid provided in jail to file the special leave petition.

Petition is dismissed.

Copy of this order be communicated to the petitioner through Superintendent, Mandoli Jail.
