% 10.03.2017 Petitioner by way of this petition appears to be aggrieved by the illegal and unauthorised construction raised by the private respondent over property bearing No.3886-87, Pul Bangash (in front) Metro Station, Main Road, Roshanara Road, Delhi.

On the last date counsel for respondent nos.1 and 2 had put in appearance. He had accepted the notice. On instructions he informs this Court today that the aforenoted properties are in fact two shops adjacent to one another; they are old shops. No constructions activity was found at the site. No illegal deviations have also been noted. He further points out that there appears to be illegal deviations on first, second and third floors of the property; the present petition does not belong to those properties. Those deviations have been booked and

necessary action will be taken qua those properties. It is reiterated that those properties are not the subject matter of the present petition. Since none has appeared for the petitioner, this petition is dismissed in default as also on merits as nothing survives in this petition.
