CRL.M.C. 5118/2018 Notice. Learned APP accepts notice for respondent no.1. Respondent no.2 is present in Court along with her counsel, who accepts notice. She has been identified by SI Sushil Kumar of police station Pahar Ganj. It is submitted that petitioner no. 1 and respondent no. 2 have settled their disputes vide Memorandum of Understanding dated 31st August, 2017. It is further submitted that the marriage of petitioner no. 1 and respondent no. 2 has already been dissolved by a decree of divorce by mutual consent on 11th May, 2018 passed by the Family Courts, Central District, Tis Hazari, Delhi. Petitioner no. 1 has paid the balance settled amount of `3 lacs to the
respondent no. 2 vide a demand draft, photocopy whereof has been placed on record. He submits that with this amount the entire settled amount stands paid to respondent no.2.
Respondent no. 2 submits that she has settled the matter with the petitioner No.1 of her own free will and without any undue force, pressure or coercion. She says that she has received the entire settled amount and has no objection in case FIR No. 250/2016 under Sections 498-A/406 IPC registered at Police Station Pahar Ganj is quashed against the petitioner No.1 and is relatives, i.e., petitioner Nos.2 to 6. Keeping in mind the settlement arrived at between the parties, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.
Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
