% 16.11.2017 CS(OS) 10/2017 and IA 9076/2017 (u/O VII R. 11 CPC) By IA 9076/2017 the defendant No.5 seeks rejection primarily on the ground that despite the learned Joint Registrar granting four weeks time to the plaintiff to file the Court fee on 11th January, 2017, till date no Court fees has been filed. No reply affidavit to this application has been filed. Neither has any Court fees been filed.

Learned counsel for the plaintiff seeks withdrawal as she has not been receiving any instructions from the plaintiffs. Since the Court fee has not been filed till date, the suit is liable to be rejected. CS(OS) 10/2017

Suit is accordingly dismissed. IA 9076/2017 is allowed. The date of 14th December, 2017 before the learned Joint Registrar is cancelled.
