Although, I was inclined to impose substantial costs on the petitioner for insisting of listing of this writ petition in this Court in spite of order passed by this Court dated 2.12.2016 in W.P(C) No. 11364/2016 titled as A.K.Srivastava & Ors. Vs. Union of India & Anr. read with penultimate para of the judgment of the Supreme Court in the case of L. Chandra Kumar Vs. Union of India & Ors. (1997) 3 SCC 261, since, learned senior counsel for the petitioner, on instructions states that this petition be allowed to be withdrawn with liberty to approach Central Administrative Tribunal (CAT), hence I am not imposing costs but putting the counsel to notice that
filing of affidavit in court is a very solemn act and if such solemn acts are incorrectly taken the courts can take a very strict view of the matter. 2.
The writ petition is allowed to be withdrawn with the aforesaid liberty.
