% 12.07.2017 The mediation proceedings have failed before the Delhi High Court Mediation and Conciliation Centre The admitted position is that under the terms and conditions of the Agreement dated 05.11.2012 between the parties, there exists an arbitration clause.
Initially the leaned counsel for the respondent urged that as per the arbitration clause, namely, Clause No. 49, the Architect of the project is to be appointed as an arbitrator. However, after some arguments, he has agreed that this court may appoint an independent arbitrator. The parties are referred to Delhi International Arbitration Centre (DIAC). The arbitration proceedings will be held under the aegis of the said Centre which may nominate the concerned arbitrator. Parties to appear before the Centre on 04.08.2017 at 3.00 P.M. The petition stands disposed of.
