Plaintiff has joined the Court proceedings virtually and submits that he does not want to prosecute this litigation. 3.

Ms. Ayushi Sharma, learned counsel accepts notice on behalf of Defendant No. 1 and on instructions from Defendant No. 1 who is present in Court has no objection to the application being allowed. 5.
Accordingly, application is allowed and disposed of. CS(OS) 352/2017 6.
In view of the order passed in I.A. 8789/2025 and in light of the fact that Plaintiff seeks to withdraw this suit, the suit is disposed of as withdrawn.
