After arguments, counsel for the appellant states that the appeal be disposed of as not pressed but appellant be given time to vacate the suit premises on or before 28.2.2018. Appellant also agrees to continue to pay the electricity charges, water charges and the admitted rate of rent of Rs.16,000/- per month till the time the appellant remains in possession of the suit premises.

Let the appellant file an affidavit of undertaking in terms of the present order and on the appellant filing the undertaking and complying with the terms of the same, appellant will not be evicted from the suit premises on or before 28.2.2018.
