BAIL APPLN. 1507/2017 This is an application under Section 439 Cr.P.C. filed on behalf of the petitioner seeking grant of interim bail in case FIR No.1635/2016, under Sections 394/397/342/452/120-B/201/506/411/34 IPC read with Section 27 Arms Act, registered at Police Station-Mehrauli, Delhi. Learned counsel for the petitioner submits that the son of the petitioner has to be admitted in class 12th and there is nobody alive in his family to make arrangement for the same. He further submits that the petitioner has to arrange money and search school for his son and prays that the petitioner be granted interim bail for a period of one month.

Status report has been filed on behalf of the State. Learned APP for State on instructions from the Investigating Officer submits that the son of the petitioner was studying in 12th class; however, on 01.05.2017 school leaving certificate was issued to him as he could not pay the fees. Learned APP has further submitted that the factum of death of wife of the petitioner has been verified.

Since the petitioner is seeking interim bail at this juncture for making arrangement of his son's admission in school, I deem it appropriate to release the petitioner on interim bail for a period of one month effective from the date of his release, on his furnishing bail bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the concerned Court below with the condition that he shall not influence the prosecution witnesses; he shall not contact, threaten or coerce the victim or any of his/her family members or to indulge in any illegal activities; he shall not tamper the prosecution evidence, he should not leave India without prior permission of the Court below and he should surrender before the concerned Court below after the expiry of 30 days.

The present bail application is disposed of accordingly. Copy of the order be given dasti, as prayed.
