O R D E R

% 04.08.2017 It is submitted that petitioners and responded nos. 2 and 3 have settled their disputes amicably, therefore, FIR No.686/14 under Sections 498A IPC and Section 3/4 of Dowry Prohibition Act registered at police station Farsh Bazar on the complaint of respondent no.3 may be quashed. Petitioner nos. 2 to 4 are relatives of petitioner no.1; whereas respondent no. 2 is daughter of responded no. 3.

It is submitted that marriage between the petitioner no.1 and respondent no.2 has already been dissolved by a decree of divorce by mutual consent on 20th April, 2017 passed by the Family Court, Shahdara, Karkardooma Courts, Delhi. Petitioner no.1 has already paid entire settled

amount to the respondent no.2.

Respondent nos. 2 and 3 are present in Court along with their counsel and have been identified by SI Avneesh Singh of police station Farsh Bazar. They admit having settled the matter with the petitioners of their own free will and without any undue force, pressure or coercion. Respondent no.2 also admits having received entire settled amount from the petitioner no.1. These respondents have no objection in case the FIR is quashed.

Keeping in mind that marriage between the petitioner no.1 and respondent no.2 has already been dissolved by a decree of divorce by mutual consent and respondent nos. 2 and 3 have no objection in quashing of the FIR, in my view, no fruitful purpose would be served in keeping the present criminal proceedings pending. Accordingly, in the interest of justice, FIR No.686/14 under Sections 498A IPC and Section 3/4 of Dowry Prohibition Act registered at police station Farsh Bazar and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
