HON'BLE MR. JUSTICE RAJIV SAHAI ENDLAW
O R D E R
% 09.08.2017 1.
Transfer is sought of a suit instituted by the petitioner himself in the Rohini Courts, Delhi to the Tis Hazari Courts, Delhi on receipt of advice, from the new counsel engaged by the petitioner, that the suit should have been filed in Tis Hazari Courts, Delhi instead of in the Rohini Courts. 2.
I have enquired from the petitioner, whether the respondents have taken any objection to the territorial jurisdiction of the Rohini Courts. 3.
The answer is in the negative.
4.
The petitioner having himself instituted the suit in the Rohini Courts, as per the advice of his earlier counsel, cannot, as per the convenience of his new advocate, seek transfer.
5.
If at all the petitioner wants to do so, the option of taking back the plaint and presenting it in the Court of appropriate jurisdiction is always available.
Dismissed.
No costs.
