% 04.09.2017 Ld. counsel for the petitioner, on instructions, strenuously contends that the petitioner was not given any hearing and the principle of audi alteram partem has been violated before passing of the impugned order dated 11.01.2017. Ld. counsel for the respondent on his part, submits that the respondent is not averse to consider a representation being made by the petitioner against the impugned demand and a fresh speaking order being passed by the respondent. Keeping in view the totality of the facts and circumstances, the writ petition is disposed off with the direction to the respondent to consider the instant writ petition as a representation of the petitioner and afford a personal hearing to the petitioner, the first of which shall be on 13th September, 2017 at 3:30 pm before Mr. Tanmay Mohanty, Assessing Officer, who has passed the impugned order and dispose off the representation within four weeks from today, by a speaking

order, which shall be conveyed to the petitioner forthwith, thereafter. Impugned order and the consequential demand raised thereon, stand quashed.
