This order is in continuation of the earlier order dated 10th August, 2017.

The counsel for the respondent appears.

The counsel for the respondent states that since the judgment relied upon by her before the Civil Judge was overruled in the year 2008, she be granted time to look up whether there is any other judgment after 2008. 4.
The preparations ought to have been done before the hearing scheduled for today and hearing cannot be adjourned to enable the counsels to prepare their arguments.

For the reasons stated in the order dated 10th August, 2017, the petition is allowed and the impugned order, dated 2nd June, 2017 in New Case No.96499/2016 (Old Case No.92/2014) of the Court of Civil Judge-1, Central District, Tis Hazari Courts, Delhi holding the respondent/decree holder to be entitled to future interest on the decretal amount even though the decree did not award any interest, is set aside. CM(M) 842/2017

The counsel for the respondent otherwise states that the decretal amount has been received.
