By this petition the petitioner seeks anticipatory bail in case FIR No. 328/2017 under Sections 376/506 IPC registered at PS Nihal Vihar, Delhi. 2.
The allegations of the complainant in the FIR were that the petitioner contacted her through facebook. Thereafter they met several times and the petitioner stated that he would divorce his legally wedded wife and would marry the complainant. It is thus claimed that on the false pretext of marriage, the petitioner established relationship with the complainant. 3.
From the FIR it is evident that the factum of marriage of the petitioner was known to the complainant when she developed the relationship with the petitioner and the only pretext attributed to the petitioner is that he would seek divorce from his wife and thus marry the complainant. BAIL APPLN. 1579/2017

Grant of divorce is not a right which the complainant would have been aware of.

Considering the nature of allegations, this Court deems it fit to grant anticipatory bail to the petitioner. Consequently, in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the Arresting Officer/SHO concerned, further subject to the condition that he will join the investigation and will not leave the country without prior permission of the Court concerned.
