Crl. MA No. 34006/2019 (under Section 482 Cr.PC seeking modification of Order dated 04.08.2017 The present application has been instituted on behalf of Smt. Luxmi Gautam, Mr. Raj Bhog Gautam and Ms. Veena Gautam, the siblings of Mr. Ratan Gautam, son of Mr. Roopchand Gautam.

Vide order dated 4th August, 2017, it was recorded that the aforementioned siblings undertake to provide care, protection and treatment to their brother, Mr. Ratan Gautam. It is in this circumstance that, Nai Kiran Social Welfare Society, where Mr. Ratan Gautam was hitherto lodged was directed to return his belongings. The siblings having undertaken as

aforesaid to take due care of their brother and ensure that, he is provided with adequate treatment for tuberculosis and alcoholism at their own cost and expense, Mr. Ratan Gautam, was permitted to reside with them for the said purpose.

The siblings have filed the present application stating that, they are no longer able to undertake the cost and expense requisite for the care and treatment of Mr. Ratan Gautam and that, therefore, they be relieved of the undertaking furnished earlier, in this behalf. In view of the circumstance that, Mr. Ratan Gautam is present before us and has expressed his desire to return to his own house, the siblings are hereby relieved of the undertaking to this Court as recorded in the Order dated 4th August, 2017.

No further directions are called for.
