Parties have settled the matter by signing an application under Order XXIII Rule 3 CPC before the Delhi High Court Mediation and Conciliation Centre and as recorded in the settlement report dated 8.1.2018. The original report dated 8.1.2018 alongwith an application under Order XXIII Rule 3 CPC signed by the parties and their counsels and supported by affidavits of the parties are on record. This satisfies the requirements of Order XXIII Rule 3 CPC. 2.

Accordingly, the suit is disposed of in terms of the settlement

CS(COMM) 1658/2016 as stated in the application under Order XXIII Rule 3 CPC and a decree will be drawn in terms of the settlement agreement dated 8.1.2018.

Parties are left to bear their own costs.

Since the matter is settled in mediation before commencement of evidence, in terms of Section 16-A of the Court-fees Act, 1870 (as applicable to Delhi), plaintiff will be entitled to refund of 50% of the court fees.

Necessary certificate be issued by the Registry of this Court in favour of the plaintiff.
