Transfer of suit No.10265/2016 to the court of Sh. Saurabh Pratap Singh Laler, Additional District Judge, Tis Hazari Courts, Delhi (Now ADJ-West, Tis Hazari Court, Delhi) is sought on the ground that the said court has already heard arguments on application under Order VII, Rule 11 of CPC.

Upon notice, respondent, who appears in person, submits that even in his application under Order XII, Rule 6 of CPC, arguments have been heard by the aforesaid court. It is submitted that the matter is now coming up before the Successor Court on 17th November, 2018. In the facts and circumstances of this case, this petition is disposed of with direction to the concerned District and Sessions Judge, Delhi to transfer the aforesaid suit to the court of Sh. Saurabh Pratap Singh Laler, Additional District Judge, Tis Hazari Courts, Delhi (Now ADJ-West, Tis CM(M) 1192/2018

Hazari Court, Delhi), for pronouncing the orders on the above-referred two applications. For this purpose, let the parties or their counsel appear before the concerned District and Sessions Judge, Delhi on 15th October, 2018.

With aforesaid direction, this petition is disposed of. Dasti to counsel for the parties.
