The challenge by this appeal is to the impugned judgment of the trial court rejecting the plaint under Order VII Rule 11 CPC. 3.

At the stage of dictation of the judgment, counsel for the appellant/plaintiff has taken instructions from the appellant/plaintiff, who is present in person, that the appeal be disposed of as not pressed.

Though, the appeal is withdrawn I would like to note that both the suit and the appeal were completely frivolous and this Court was RFA 767/2017

at the stage of dictation of the judgment for dismissing this appeal with costs, and at which stage the appellant has given instructions not to press the appeal.
