O.M.P. (E) (COMM.) 29/2018 This is a petition under Section 27 of the Arbitration and Conciliation Act, 1996 (in short '1996 Act'). Mr. Jagjit Singh, who, appears for the petitioner, says that pursuant to the order dated 24.08.2018, passed by this Court, only one of the witnesses appeared before the learned Arbitrator. This contention is sought to be supported by Mr. Jagjit Singh by drawing my attention to the order of the learned Arbitrator dated 17.09.2018. 3.1 The learned Arbitrator, in the said order, notes that pursuant to this Court's order, though, summons were served on the Manager (Operation Service), Johnson Control India Private Limited, he did not appear before him as directed.

Accordingly, the prayer made in the petition is allowed. The Manager (Operation Service), Johnson Control India Private Limited, located at Quantum Building, Ground Floor, C-3, Sector-3, NOIDA201301, shall appear before the learned Arbitrator on 04.10.2018 at 02:00 PM at the Delhi International Arbitration Centre, Delhi High Court and on other dates, hereafter, which the learned Arbitrator may fix for his appearance.
