% 15.05.2017 I.A.No.3848/2017 Present application has been filed for discharge by counsel for the defendants.

Since the defendant no.1 who is also Director of defendant no.2 is personally present in Court and who has been identified by learned counsel for the plaintiffs, states that he has no objection to the counsel being discharged, the present application is allowed. I.A.No.3740/2017 Present application has been filed under Order XXIII Rule 3 read with Section 151 of CPC. The same is duly signed by the parties to the litigation as well as by the learned counsel for the plaintiffs. Present application is also supported by the affidavits of constituted attorneys of the plaintiffs as well as the defendants. Learned counsel for the plaintiffs states that the matter has been compromised in accordance with the terms mentioned in the present

joint application.

The authorised representative of the plaintiffs and the defendants further assure and undertake to this Court that the parties shall comply with the terms of the settlement mentioned in the present joint application.

The aforesaid statements, assurances as well as undertakings mentioned in para three of the joint compromise application are accepted by this Court and parties are held bound by the same. This Court has also perused the terms of the compromise application and is of the opinion that the compromise is lawful. Consequently, the suit is decreed in terms of the joint compromise application dated 22nd March, 2017 marked as „Ex. C-1‟. Registry is directed to prepare a decree sheet in terms of para three of the compromise application.

With the aforesaid observations, present application is allowed and the suit and all pending applications stand disposed of. MANMOHAN, J MAY 15, 2017 KA
