% 21.03.2018 After some arguments Mr. Pramod Ahuja, learned counsel appearing on behalf of the appellant seeks leave to withdraw this appeal. Leave granted.
However, it is directed that the appellant-husband pay to the respondent-wife the arrears of maintenance in terms of the directions rendered in the impugned order, within a period of four weeks from today. We are also informed at the Bar that the petition instituted on behalf of the appellant for divorce on the ground of cruelty is currently at the stage of recording of evidence and is now fixed on 24.3.2018 before the learned Court Commissioner, appointed for the said purpose. MAT.APP.(F.C.) 139/2017
It is hoped and expected that the said petition shall be adjudicated expeditiously and preferably within a period of six months from the next date of hearing.
