O R D E R

% 23.11.2017 FIR 18/2011 under Section 363 IPC was registered at police station Delhi Cantt. on the complaint of respondent no.2 Sunil Kumar alleging therein that her daughter Neha, who was aged about 17 years went missing from home on 7th February, 2011 since 8:30 in the evening, he suspected that petitioner had taken away his daughter with her after enticing her. Neha was recovered the next morning and her statement under section 164 Cr.P.C. was recorded wherein she did not level any allegation of petitioner having established physical relations with her. It was rather stated by her that the petitioner had taken her for a stroll and they travelled in metro and at night, he dropped her at Mayur Vihar and went away.

During investigation, age of Neha was found out to be more than 18 years. Neha is already married.

It is submitted that petitioner and respondent no.2 have now settled their disputes amicably.

Petitioner is also a young boy who was aged about 22 years during relevant time.

Respondent no.2 is present in Court and admits having settled the matter with petitioner of his own free will and without any undue force, pressure or coercion.

He submits that he has no objection in case the aforesaid FIR is quashed.

Keeping in view the facts and circumstances as detailed hereinabove, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
