CORAM:

HON'BLE MR. JUSTICE S.P.GARG

O R D E R

% 19.07.2016 1.

Present petition under Section 482 Cr.P.C. has been preferred by the petitioners for quashing of the FIR No.190/2012 registered under Sections 498A/406/34 IPC at PS Uttam Nagar. It is stated that the matter has been settled amicably with the respondent No.2 / complainant.

2.

Respondent No.2 / complainant is present with her counsel and has been identified by the Investigating Officer. I have enquired from the complainant if she has settled the dispute with the petitioners amicably without any fear or pressure. She has informed that all the disputes between the parties have been resolved amicably with her free consent and she has no objection to the quashing of the FIR if the amount unpaid be given to her.

CRL.M.C. 3057/2015

3.

Learned counsel for the petitioners has given `1 lac in cash to the complainant in the Court today out of the settled amount which was liable to be paid at the time of quashing of the FIR. The respondent No.2 / complainant further claimed `25,000/- as expenses incurred by her. The petitioners have also given `25,000/- in cash to the respondent No.2 / complainant voluntarily in the Court. 4.

Since the matter has been settled between the parties with their free consent and divorce by mutual consent has since been granted, no useful purpose will be served to continue with the proceedings. In the interest of justice and to enable the parties to put an end to the litigation and to settle in life after divorce, FIR No.190/2012 registered under Sections 498A/406/34 IPC at PS Uttam Nagar and all the proceedings arising therefrom are quashed. 5.

The petition stands disposed of accordingly.
