% 20.02.2017 Learned counsel for the plaintiff submits that as per the various findings, the Court finds the issue of payment of court fee is an issue between the plaintiff and the State and the defendant and the defendants has no role to play.
It has further submitted that plaintiff has no money to pay the court fee. In view of the fact that the court fee has not been filed despite number of times, the present suit is dismissed under Order 7 Rule 11 CPC. At this stage, counsel for the plaintiff seeks permission to file fresh case, in case he is able to arrange the court fee. Subject to other legal laws relating to the limitation etc., permission granted as prayed for. All the pending applications also stand dismissed. DEEPA SHARMA, J FEBRUARY 20, 2017/neelam
