% 04.01.2017 The grievance of the petitioner is that the court of North East District, Delhi is the appropriate court to try the suit. He submits that District Judge is not in a position to transfer the matter and hence, the present petition praying that the matter be directed to be listed before the court of competent jurisdiction.

Appropriate remedy of the petitioner is to file a transfer petition under Section 24 CPC. The petition is accordingly dismissed granting liberty to the petitioner file a transfer petition under Section 24 CPC. JAYANT NATH, J.
