W.P.(CRL) 3681/2016 Issue notice. Ms. Vohra accepts notice on behalf of the State. Respondent No.2 is present in person and she also accepts notice. She is also represented through counsel Mr. Kulish Kumar. She is identified by the I.O., who is present in Court.

This petition has been preferred by the petitioner to seek quashing of FIR No.345/2015 dated 21.02.2015 registered at PS - Malviya Nagar under Section 354/ 354D/ 509 IPC and the proceedings arising therefrom. The said FIR came to be registered on the complaint of respondent No.2. According to the allegations in the FIR, the complainant was working in the same office where the petitioner was also serving. She was junior to the petitioner and the petitioner indulged in repeated conduct leading to registration of the FIR aforesaid.

Respondent No.2, who is present in Court states that she had to quit her job on account of the conduct of the petitioner. A perusal of the FIR shows that the allegations made against the petitioner are rather serious. The only reason why the complainant does not seem to be interested in pursuing the matter is to be able to move on in her life. Looking to the nature of allegations, I was not inclined to quash the FIR and the proceedings arising therefrom. The petitioner has, however, submitted that to show his bona fide, he is willing to atone for his conduct. He has left to this Court to impose such damages/ costs as this Court may consider appropriate.

Looking to the circumstances of the case, subject to the petitioner depositing in this Court a sum of Rs.2 Lakhs within four weeks, the FIR in question and the proceedings arising therefrom shall stand quashed. Out of the said amount, this Court shall transmit Rs.1 Lakh to the Prime Minister's National Relief Fund, and the remaining amount of Rs. 1 Lakh shall be released to the respondent No.2. This is further subject to the condition that the petitioner shall in no way interact with the complainant, or contact or call her. Only after the amount is deposited in this Court and the proof of

the said deposit is provided to the I.O., the FIR in question and the proceedings arising therefrom shall stand quashed. VIPIN SANGHI, J DECEMBER 23, 2016 B.S. Rohella
